If you’re going through probate, you may have just lost a loved one. One thing that many people realize after losing a loved one and going through probate is that you need to make sure your wishes are clear. Both for what will happen to your estate after you die and what your wishes are if you become ill or unable to speak for yourself. So, while we discuss estate planning and probate regularly on this blog, many of our clients express that they wish their loved one had had specific instructions for when they were ill before they died. In this state, such a plan is called a California Advance Health Care Directive.
California Advance Health Care Directive
A California Advance Health Care Directive can be a part of your estate plan. This plan informed your loved ones of very specific conditions under which you would or wouldn’t want to continue medical care. For example, your loved ones might assume that you wouldn’t want to be on a machine to keep you breathing if you were incoherent. Yet, maybe you want to have every possible action taken to prolong your life. Or maybe the reverse is true. A California Advance Health Care Directive can even state that you want all life-saving measures taken no matter what your prognosis is said to be. When you create a California Advance Health Care Directive, you’ll choose someone to have healthcare power of attorney authority for you. Keep in mind, this person may need to enforce your wishes even in the face of family objections, so consider this agent carefully!
