We’ve talked about overbidding on California probate real estate recently. One question we have been getting asked though is this: What money should I bring to court when overbidding on a probate offer. This is an excellent question. Actually, many come to court completely unprepared and waste their own time. The court won’t even allow you to overbid on a probate property in Los Angeles County, for example, unless you have a cashier’s check in hand.
The cashier’s check must be at least as much as 10 percent of the opening bid in order for you to even participate. Personal checks are absolutely not allowed. The cashier’s check has to be made payable to the estate, the trust or the conservatorship, whichever type of sale it is. The listing agent can provide you with this information before you go to court to overbid.
