Probate law indicated specific things that must be included in a Notice of Proposed Action. The personal representative has to notify all of the pertinent parties that a sale is pending. To do this, they use a form called the “Notice of Proposed Action.”

The form will explain the terms that the personal representative is about to proceed with on behalf of the estate. For example, if they intend to sell a house, that requires notifying heirs. The notice has to include several specific things.

For starters, the personal representative’s name and mailing address must be stated on the notice. Also, the name and phone number of someone to contact with any questions must be included on the form. Plus, an accurate description of the action that is about to happen must be provided. A description of the property to be sold must be included. The material terms of the sale has to be included. If an exchange or granting of an option to purchase the property is about to happen, that must be listed. The sale price and the method of figuring out commissions to brokers also has to be listed. Lastly, the date when the proposed action is set to happen also has to be listed.
